Welcome to TalentHQ. These Terms of Service ("Terms") govern your access to and use of our platform, including any content, functionality, and services offered through
www.talenthq.ai (the "Platform"). By using our Platform, you agree to be bound by these Terms.
By using the TalentHQ platform you are agreeing to these Terms of Service.
1. Who We Serve
TalentHQ provides services to:
- Clients: Employers or recruiters seeking to find and evaluate candidates.
- Candidates: Individuals applying for roles, participating in interviews, and being assessed via the platform.
2. Account Registration
- Clients are required to create an account to post jobs and access candidate reports.
- Candidates can apply and complete interviews without registering for an account.
- You must provide accurate and complete information and keep your credentials secure. You are responsible for all activity under your account.
3. Use of the Platform
You agree not to use the platform:
- For any unlawful purpose
- To distribute spam or malicious software
- To impersonate others or misrepresent your affiliation
- To interfere with the platform’s normal operations
We reserve the right to suspend or terminate access to any user found violating these terms.
4. Use of AI and Automated Systems
TalentHQ uses artificial intelligence to support the hiring process. This includes:
- Generating interview questions
- Assessing candidate responses
- Matching profiles to job descriptions
While our AI is designed to support fair and consistent evaluation, all automated decisions are subject to review. TalentHQ is not liable for any hiring decisions made based on AI-generated output.
5. Intellectual Property
All content, software, branding, and materials provided on the platform are the property of TalentHQ or our licensors and are protected by copyright, trademark, and other laws.
You may not reproduce, distribute, or exploit any part of the platform without prior written permission.
6. Data and Privacy
Use of our platform is also governed by our
Privacy Policy, which outlines how we collect, use, and store your data.
By using TalentHQ, you consent to our data practices as described in the Privacy Policy.
7. Confidentiality
All candidate evaluations, interview data, and job-related materials are confidential. Clients and candidates agree not to share or publicly disclose platform content without prior consent.
8. Payment and Fees
For Clients: TalentHQ charges a success-based fee when a candidate is hired through the platform. Fee structures and payment terms are agreed upon separately in writing or contract.
For Candidates: There is no fee to use the platform or participate in interviews.
9. Termination
We reserve the right to suspend or terminate your access at our sole discretion if you violate these Terms or misuse the platform.

10. Disclaimers
- TalentHQ is not responsible for the accuracy of job descriptions or candidate-supplied information.
- We do not guarantee that any candidate will be hired or that any job will be filled.
- The platform is provided "as is" without warranty of any kind.
11. Limitation of Liability
To the maximum extent permitted by law, TalentHQ shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the platform.
12. Additional Terms
12.1 Non-Circumvention
Clients may not bypass TalentHQ to directly hire or compensate any candidate introduced through the platform without written consent. Breach of this clause constitutes a material violation and may result in termination and liability for damages.
12.2 No Data Extraction
Clients are prohibited from copying, downloading, or extracting any data from the TalentHQ platform, including resumes, interview content, or user profiles. Unauthorized extraction is considered theft of proprietary information.
12.3 Salary Transparency
Clients must provide accurate and complete information regarding any job offer extended to a candidate sourced through TalentHQ, including the full first-year compensation. Any misrepresentation or withholding of offer details will be considered a material breach of these Terms and may result in additional fees or removal from the platform. TalentHQ reserves the right to verify offer details directly with the candidate.
12.4 Payment Terms
Success fees must be paid within 30 days of the candidate’s start date. Late payments will incur interest at 1.5% per month or the maximum legal rate.
12.5 Platform Removal
TalentHQ reserves the right to remove a Client from the platform at its discretion. Grounds may include late or non-payment, misconduct, or breach of these Terms.
12.6 Indemnification
Each party agrees to indemnify and hold the other harmless from any claims, losses, or damages arising from their respective use or performance under these Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in San Francisco, California, and the parties hereby irrevocably consent to the jurisdiction and venue of such courts.
14. Changes to These Terms
TalentHQ reserves the right to modify, update, or change these Terms of Service at any time without prior notice. Any changes will be effective immediately upon posting the revised Terms of Service on the TalentHQ platform. TalentHQ will make best efforts to notify users of any material changes to the Terms of Service, such as through email or a prominent notice on the platform. However, it is the Client's and Candidate's responsibility to review the Terms of Service periodically for any updates or changes. The Client's and Candidate's continued use of the TalentHQ platform after the posting of any changes constitutes their acceptance of the revised Terms of Service. If the Client or Candidate does not agree to the revised Terms of Service, they must discontinue their use of the TalentHQ platform.
